Here at Kendalls Solicitors we pride ourselves in the knowledge and representation we are able to provide in this field of law.

Both Robin Phoenix and Imran Hussain, who between them have over 50 years of experience in this area of law, bring differing experiences to their practice than most other lawyers.

If you are reading this, then you are in need of our services in respect of one or more Motoring Offences.

It is generally the case, that those requiring such assistance have never found themselves in this situation before and are therefore in unfamiliar territory. At Kendalls we have the experience and knowledge in this specialist field to answer your questions and put you at ease.

If you have been charged or reported with a motoring offence (or are anticipating such) then we can help you.  Offences such as Speeding, Driving without due care and attention, Driving whilst above the alcohol/drugs limit, amongst many others require the assistance of specialist Solicitors.

Whilst the Offence itself is worrying, then so are the potential costs involved. Below we set out the costs that are likely to arise for matters in this particular area of law.

Our fees for dealing with motoring matters can vary depending on whether there is likely to be a Guilty or Not Guilty plea, the number of hearings involved and the location of the Court that is seized of the matter.  It will be necessary for us to acquire all the facts and details of your particular matter and of your own personal circumstances, along with acquiring full disclosure and possible liaison with both the Prosecuting Authorities and Courts.

We offer both Fixed fees and Hourly Rates, depending upon the nature of the matter. Our hourly rates are the same for both of our Solicitors at up to a maximum of £200 per hour.

All of our Fees and Disbursements are subject to VAT @ 20%.

Initial Advice up to one hour – Fixed Fee - £200  Plus VAT @ 20%.

Single Hearings at the Magistrates Court – For those matters that can only be dealt with at the Magistrates Court on a single hearing then our fees range from £500 to £1,500 Plus VAT @ 20 %.

These fees include.

  • Attendance upon your Solicitor to provide instructions
  • Consideration of disclosure documents (if available)
  • Advising you on the matter you face and the relevant plea and sentence.
  • Where relevant, (potential loss of Driving Licence) whether Special Reasons or Exceptional Reasons arguments are available and or viable.
  • Explaining the Court process and what to expect.
  • Attendance and representation at a single court hearing at the Magistrates Court only.
  • Confirmation of the outcome of the hearing and advise re next steps(if any) and cost implications.


The fees quoted above are Fixed and include the services detailed above. However, there may well be factors which may increase the fee in your matter. Where this is likely to result in additional costs, then you will be kept informed at an early stage along with the anticipated costs.

Services not included in the Fixed Fee

Should you decide to Plead not guilty or your matter requires an adjournment, i.e. for trial, this is not included in the fixed fee. Neither will the fixed fee include any of the following services which will be charged at our hourly rate (see above).

  • Preparation for trial and representation at trial.
  • Travel costs and disbursements.
  • Instruction of any expert witness.
  • Statement taking from any expert witness.
  • Advice and assistance in relation to a Special Reasons hearing.
  • Advice and assistance in relation to an Exceptional Hardship hearing.
  • Any additional hearings.
  • In the event you are unhappy with the outcomes, the cost of challenging a decision or considering your options on appeal.
  • Hearings before the Crown Court.
  • Attendance at any Court outside the Lancashire area.

Expenses and disbursements are not included in the fee quoted.  Examples of such include:

  • Instruction Counsel (£1.000 Plus =VAT @ 20%)
  • Interpreters fees (£50 plus per hour = VAT @ 20%)
  • Translation of documents (£25plus per hour = VAT @ 20%)
  • Instruction of any Expert witness. Each matter stands on its own merits and will be looked at individually. We will obtain a quote from a third party and agree the fee with you before giving the go ahead for and such engagement. VAT is normally payable.

Key stages  (based on a guilty plea and that you have a date for a hearing)

  • Meet with your solicitor to provide instructions on what happened.
  • We will consider initial disclosure, and any other evidence and provide advice.
  • Arranging to take any witness statements if necessary (this will have an additional cost, of £200 + VAT per hour + disbursements).
  • We will explain the court procedure to you so you know what to expect on the day of your hearing, and the sentencing options available to the court.
  • We will conduct any further preparatory work, obtain further instructions from you if necessary and answer any follow up queries you have.
  • We cannot provide a timescale of when your hearing will take place, as this depends on the court listing for that day.
  • We will attend court on the day and meet with you before appearing in front of the court. We anticipate being at court for half a day.
  • We will discuss the outcome with you. If advice is required on appeal, this will carry an additional cost.

We have outlined what we should expect from you.  In return we would ask that you attend promptly when asked to and provide us with any information or material we may find appropriate as soon as possible. Remember, we are only as good as the instructions/information you give us.
